By an information filed in the Circuit Court of New Madrid County, Missouri, the appellant Burgess was charged with murder in the first degree. The crime was alleged to have occurred on November 2, 1963. An application for a change of venue was granted and the cause was transferred to the Circuit Court of Mississippi County.
