This is an appeal from a judgment of the district court of Lewis and Clark County in favor of the plaintiff and from an order denying a new trial.

In 1959 the plaintiff, Clarence A. Ryan, decided to establish a laundromat. Norman Dalry, a salesman for the defendant company, Ald, Inc., contacted the plaintiff at the latter's request.
