Petitioner, Arley Ward, was charged with the crime of murder in the District Court of Tulsa County, Oklahoma, in 1947. After two days of trial, and before the case was submitted to the jury, the record shows that Petitioner changed his plea from "not guilty" to "guilty" of manslaughter in the first degree, and was sentenced by the Court to serve a term of forty years in the State Penitentiary.
