The cause before us on appeal originated in an action brought to recover damages which were sustained by Plaintiff Henry Nichol when he fell into moving machinery while on farm property owned by Defendant Ross Munson. The facts are undisputed. Plaintiff, age 67, had been in the trucking business for many years and he and his partner used two trucks to haul hogs and cattle for various farmers in the community to Chicago, Illinois, and Davenport, Iowa.
