Defendant was charged by county attorney's information with the crime of burglary in breaking and entering a dwelling house in the night time with intent to commit larceny, in violation of section 708.1, Code 1962, I.C.A. He pleaded not guilty, was tried before court and jury, found guilty and, as provided by section 708.3, sentenced to an indeterminate term not exceeding 20 years in the men's reformatory at Anamosa.
