This case is before the Court upon the petition of Edwin Marious Bertsch, hereinafter called petitioner, for writ of habeas corpus.

Petitioner was tried and convicted of the offense of murder with malice aforethought on January 29, 1963, in the 22nd District Court of Fayette County, Texas.
