This action arises as a result of a complaint filed on December 10, 1962 by the plaintiff corporation which owns a ski lodge named The Topnotch located in Stowe, Vermont. The original defendants in the action were Perry H. Merrill, Director of Forests and Parks for the State of Vermont and Albert W. Gottlieb, State Forester for the State of Vermont.
