This tragic case is an action under the Federal Tort Claims Act, 28 U.S.C. §§ 1346(b), 2674. While serving in the Navy in England during World War II plaintiff had attacks of breathing difficulty. When his battalion returned to the United States in 1944 he was treated for sinusitis in the Naval Hospital at St. Albans, New York.
