Plaintiff in error, hereinafter referred to as the defendant, suffered an adverse judgment entered in favor of Doty Agency of Credit Control, Inc. The complaint filed by the latter was brought upon a promissory note admittedly signed by the defendant. It was alleged in said complaint:

"1. That the amount in controversy does not exceed $2,000.00 "2. That on or about the 30th day of September, 1960, at Denver, Colorado, the Defendant...
