Although these two cases arose out of the same accident, were tried together, and in many respects are factually identical, the respective causes of action are entirely different. It seems best, however, to consider them in a single opinion.

At about 6:30 on the morning of Monday, March 24, 1958, Alex Pluhowsky, the plaintiff in the first case, was operating his automobile southerly along State Street...
