The first question raised on this appeal is whether the rules and regulations of the National Association of Professional Baseball Leagues, included in the complaint as paragraph 6, were properly stricken. Plaintiff contends that the rules were properly included in the complaint because they constitute the contract which "governs the relationship between the plaintiff and the demurring defendants."
