Motion has been made to dismiss the writ of error on the ground that the bill of exceptions contains no proper assignment of error, the sole assignment of error being too general and indefinite to present any question for decision by this court. The bill of exceptions recites that the instant case is "a common-law action in ejectment in the fictitious form,"
