Defendant, William H. Woolery, was charged with the murder of his fifteen-year-old step-daughter, Paula Dinnell. The pertinent facts are as follows: On July 24, 1960 defendant was at the home of Mrs. Ida Adelle Smith. Defendant's wife, Elizabeth Woolery, arrived at the Smith home in a taxicab at approximately 2:30 a.m. She asked for her husband and was told by Mrs. Smith that he was not there.
