Plaintiff Jurd was injured on August 6, 1950, when he was struck by a jeep owned by the Yuba City Union High School District and being then operated by its employee Ed Johnson. The accident occurred in the course of a deer hunting expedition. Plaintiff brought suit against both the school district and Johnson. The trial court specifically found that Johnson was negligent but that he was not acting within the course and scope of his employment. Accordingly...
