In 1955, Summit Timber Company entered into an agreement with Gene Brommer, doing business as Brommer Logging Company, to log and deliver an estimated thirty million board feet of timber, from an area described as the Sulphur Creek timber sale. The terms and conditions of the agreement were incorporated in a letter dated November 25, 1955, signed and approved by both parties, as follows:

"An oral agreement has been made with you to log the Sulphur...
