This appeal is from an order of the District Court denying Chereton's petition for a Writ of Error Coram Nobis.

On January 6, 1956, in the District Court, the Grand Jury returned an indictment against Chereton containing five counts. The first count charged him with conspiracy to use the mails to defraud in violation of Sections 371 and 1341 of Title 18, U.S.C. and alleged three overt acts in furtherance of the conspiracy.
