This is an action by a former employee of defendant for wrongful discharge. Defendant moves pursuant to Fed.R. Civ.P. 12(b) (1, 6), 28 U.S.C.A. to dismiss the complaint, on the grounds that the court lacks jurisdiction over the subject matter, and that the complaint fails to state a claim upon which relief can be granted.
