SALSMAN, J.

The plaintiff sought damages from defendant for personal injuries, and appeals from an adverse judgment based on a jury's verdict. There is no contention that the evidence does not support the judgment. The only basis for the appeal is a claim of error in the court's instructions to the jury.

The accident occurred September 3, 1947, a few days after plaintiff's 14th birthday. Suit was filed August 24, 1955,
