Plaintiff, Aaron Lewis, is a riparian owner of land on Mine Au Breton Creek near the City of Potosi in Washington County, and filed this action against the City of Potosi in the circuit court of Washington County. Later it was, on change of venue, transferred to the circuit court of Jefferson County. The petition in said suit was in three counts.
