The plaintiff in error, Bob Nila Stanford, who will hereinafter be referred to as defendant, was charged by information filed in the district court of Tulsa County with the crime of second degree burglary, by breaking and entering, after former conviction of a felony; was tried, convicted and his punishment fixed at 15 years in the state penitentiary.
