TOMLINSON, Justice.

This case has been in our Courts for a number of years. One issue thereof, and renewed here, was decided by this Court in the early part of 1955 in the case of Evans v. Mayberry et al., 198 Tenn. 187, 278 S.W.2d 691, 279 S.W.2d 705. The Court of Appeals is in accord with the findings and decree of the Chancellor. Evans seeks certiorari. It was granted.
