This is a medical malpractice action in which the plaintiff, Frank Gonzales, seeks to recover damages from the defendant doctors, Donald Peterson and Burke Lair, resulting from their alleged negligence in the diagnosis and treatment of plaintiff's fractured left ankle. At the conclusion of the plaintiff's evidence, in a trial before a jury, each of the defendants challenged the legal sufficiency of the plaintiff's evidence and each moved for a dismissal...
