AYRES, Judge.

This is an action for the cancellation of an oil, gas and mineral lease so far as it covers and affects plaintiff's 3/8 mineral interest in a tract of 180 acres of land in DeSoto Parish, Louisiana.

The basis of this action is that, notwithstanding a well was drilled on the leased premises, the well was not a producer of either oil, gas or other minerals in commercial or paying quantities, and, as a consequence, it is contended the lease terminated...
