The subject of the findings and conclusions hereinafter set forth is a nighttime collision which occurred on January 5, 1959, when the ferryboat Tompkinsville, owned and operated by the petitioner, the City of New York, collided in Upper New York Bay with a light oil barge, the Texaco 396, owned and operated by the petitioner, Texaco, Inc., formerly the Texas Company.
