This action was instituted by a trustee in bankruptcy to set aside, as an illegal preference, a payment made by the bankrupt to the defendants.

Nathan's Clothes Shop, Inc., the bankrupt (hereinafter referred to as Nathan's), was a clothing store in Tacoma. Prior to January 1, 1958, Nathan's was in arrears in the amount of five hundred twenty-five dollars on account of merchandise bought from the defendants...
