Plaintiff seeks a preliminary injunction restraining the Collector of Customs from interfering with her importation of a copy of a book entitled, "Tropic of Cancer," by Henry Miller. The government cross-moves for summary judgment dismissing the complaint. On oral argument plaintiff also asked for summary judgment, i. e., for a permanent injunction and declaratory judgment.
