The indictment under which appellant was tried alleged that he "did wilfully burn one automobile then and there the personal property of and belonging to Leroy Vaughn."

Upon a finding that the indictment alleged a misdemeanor, the cause was transferred to County Criminal Court where a trial before the court on a plea of not guilty resulted in a judgment of conviction finding appellant guilty as charged and assessing his punishment...
