Tomas Figueroa, the plaintiff, was a passenger-guest in a vehicle driven by Jose Garcia. He sued Clarence Treece for injuries he sustained in an intersection collision, but failed to obtain any favorable findings that Treece was negligent. Plaintiff undertook to prove that Treece was negligent in driving at a speed in excess of that which a reasonably prudent person would have driven, and in failing to keep a proper lookout.
