The declaration charged that plaintiffs had entered into an oral contract with defendant, according to the terms of which plaintiffs were to be paid 65% of the gross revenue derived from transporting freight over highways, that they had performed the work contemplated, and that deductions had been made improperly from their earnings, in total amount, $950,000.
