At the request of plaintiff, the trial of this action has been continued since November 14, 1958. This has been done in order to await the decision of the Supreme Court and/or the Appellate Court of the State of Indiana in the case of Biel, Inc. v. Kirsch, Ind.App.1958, 153 N.E.2d 140. In that case the same question of law was presented which has been presented by defendant's fourth defense in this action...
