The plaintiffs, John L. Lewis, Henry G. Schmidt and Josephine Roche, Trustees of the United Mine Workers of America Welfare and Retirement Fund of 1950, filed a complaint in this Court on February 16, 1959, against the defendant alleging that the defendant and the United Mine Workers, on three separate occasions, in 1952, 1955, and 1956, had entered into agreements whereby the defendant was required to pay into the Fund the sum of 40 cents...
