The conviction is for felony theft; the punishment, five years.

The indictment alleged that appellant "while acting together with Ivan Estes Hill, J. W. Jennings and Jimmie Stewart" fraudulently took from the possession of T. C. McLain $75 in United States currency of the value of over $50.

T. C. McLain was the President of McLain Oil Company, a corporation, which operated a number of service stations.
