HALBERT, District Judge.
Defendant Claude Delbert Beavers has moved to vacate and set aside the sentence imposed on him by this Court under Count Two of the Indictment on file in this case. Defendant is now being held in the United States Penitentiary at McNeil Island, Washington, under said sentence.
