The plaintiff, Wood Coal Company, Incorporated, a corporation, instituted the statutory proceeding of motion for judgment in the Circuit Court of Raleigh County, under provisions of Code, 56-2-6, against the defendant, Little Beaver Mining Corporation, a corporation, to recover the sum of $3,218.26, alleged to be due under the terms of a written contract between the two parties for coal sold and delivered by the plaintiff to the defendant.
