This is an appeal on questions of law from a judgment of the Probate Court in an action in which plaintiff asked the Probate Court to make a declaration of the rights of the parties under the last will and testament of Elsie M. Kuhn, deceased, and particularly of their rights under the second and third items thereof. We quote those items:
