This is an action instituted in the third circuit court for damages allegedly sustained by plaintiff as a result of an automobile collision on a public highway in Hilo, Hawaii. Upon the complaint was endorsed plaintiff's demand for a trial by jury. Defendant joined issue by duly answering the complaint.
