Plaintiff appeals from an order dismissing his action for damages allegedly resulting from the defendant's failure to properly care for plaintiff's cattle under a certain lease agreement.
On November 5, 1956, the parties entered into a written lease whereby plaintiff rented his farm to the defendant for a term of four years. One of the terms of the lease was as follows:
