This is an appeal on questions of law from a declaratory judgment of the Court of Common Pleas pertaining to the use which the defendant, Board of County Commissioners, may make of part of the proceeds of a two-million-dollar bond issue approved by the voters of Montgomery County on November 6, 1945, for the purpose of "purchasing or constructing a fireproof building, and a site, and equipping and furnishing the same for a courthouse and jail * * *."...
