CHAVEZ, Justice.

The action is for personal injuries. From a judgment based on a jury verdict for the defendant, plaintiff appeals.

Rio Grande Boulevard is a much traveled public thoroughfare running north and south in the city of Albuquerque. At the approximate point where this cause of action arose, the roadway was 19 feet and 10 inches in width. It has since been widened. It is flanked by residences on both the east and west boundaries.
