ASHBURN, J.

By an indictment defendant was charged with violation of Health and Safety Code, section 11500, in that he did sell and furnish a narcotic, to wit, heroin. He was tried without a jury and found guilty as charged. The trial court denied defendant's motion for a new trial and application for probation, and sentenced him to state prison. From the judgment he appeals, the principal contention being that the evidence — the heroin — was illegally...
