Plaintiff has instituted this suit against the United States to recover the pay and allowances alleged to be due him for service as an Army major for the period since June 19, 1954. The case was referred by the court, pursuant to Rule 45, 28 U.S.C.A., to Mastin G. White, a trial commissioner of the court, with directions to make findings of fact and recommendations for conclusions of law. The commissioner has done so in a report filed November 5, 1958...
