OPINION BY RHODES, P.J., November 11, 1959:

This is an appeal by claimant1 from a decision of the Unemployment Compensation Board of Review refusing benefits to claimant on the ground that he was not "unemployed" within the meaning of section 401, 43 PS § 801, as that term is defined in section 4(u) of the Unemployment Compensation Law, 43 PS § 753(u).

Claimant was laid off because of lack of work on August 14, 1958....
