FRASER, Justice.

This is a malicious prosecution suit brought by appellants against appellees, claiming that appellees (hereafter known as defendants) had maliciously caused the prosecution of plaintiffs, and set in motion the machinery of the law so as to cause the plaintiffs to be indicated by the grand jury of Andrews County with a charge of theft. The trial court entered summary judgment for defendants, from which action this appeal has been taken.
