This case arises under the Fair Labor Standards Act of 1938 (Title 29 U.S.C.A. § 201 et seq.), hereinafter referred to as the Act.

At all times pertinent hereto the defendants owned and operated in Tyler, Texas, a business known as the Hi-Way Auto Wrecking & Supply Company, hereinafter referred to as the Wrecking Company.
