The defendant's appeals under G.L. (Ter. Ed.) c. 278, §§ 33A-33G, as amended, bring here issues similar to those discussed in Commonwealth v. Hanley, ante, 384. The defendant was found guilty upon five indictments as a participant in the armed assault with intent to rob, on November 25, 1951, for which Hanley was indicted as an accessory. The indictments against the defendant were returned on May 16, 1952. He was taken into custody...
