On October 22, 1956, Luther Bailey, a Negro man, hereinafter called petitioner, was adjudged guilty of the crime of rape upon the person of a white woman by the Circuit Court of Pulaski County, Arkansas, First Division, and was sentenced to death; the Supreme Court of Arkansas affirmed, Bailey v.
