Petitioner was convicted of a felony and sentenced by the Circuit Court of Kanawha County, West Virginia, on August 12, 1949, to a term of five years in the State Penitentiary. From this confinement petitioner escaped and subsequently was indicted in the Circuit Court of Randolph County, West Virginia, for feloniously stealing an automobile and for unlawfully and feloniously escaping from a prison guard.
