The plaintiff in error, Ervin Homer Scearce, hereinafter referred to as defendant, was tried and convicted in the district court of Oklahoma County where he was charged with the crime of burglary in the second degree, after former conviction of a felony, and was sentenced by the court, the jury having been unable to agree upon the punishment to be assessed, to serve a term of fifteen years in the State penitentiary...
