The appellant, Carlo Eleton, was convicted of voluntary manslaughter in the killing of Eugene Whitis of Clay County in June, 1955, and was sentenced to twenty-one years' imprisonment.

The badly bruised, bleeding and unconsious victim was found lying across the white center line of Highway 421, near Manchester, about 2 o'clock in the morning, and was rushed by ambulance to Lexington where he died in a few hours. Whether the deceased...
