This case is before the Court on a Clerk's Transcript. Defendant was charged by an indictment returned by the Grand Jury of Lee County, Iowa, and duly filed on September 7, 1956, with the commission of the crime of sodomy with Patrick S. Russell, contrary to the provisions of Section 705.1 of the Iowa Code of 1954, I.C.A.
